Welcome to Firepit. These Terms of Service ("Terms") govern your use of the Firepit mobile application (the "App") operated by Firepit ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 17 years of age to use Firepit. The App is rated 17+ and contains content that may include mild references to sexual topics and alcohol. By using the App, you confirm that you meet this age requirement.

If you are a parent or guardian and believe your child under 17 is using the App, please contact us at support@firepit.app so we can take appropriate action.

2. Description of Service

Firepit is a conversation card game app designed to help people have deeper, more meaningful conversations. The App provides:

• Curated conversation cards in multiple game modes (Truth and Fun)
• The ability to swipe through, save, and interact with question cards
• The ability to create custom question cards
• Personalized card recommendations based on anonymous preferences

3. User Conduct

By using Firepit, you agree to:

• Use the App in a lawful and respectful manner
• Not use the App to harass, abuse, or harm others
• Not attempt to reverse engineer, modify, or tamper with the App
• Not use the App for any commercial purpose without our written consent
• Not attempt to circumvent any content moderation or blocking measures

4. User-Generated Content

Content Guidelines

Firepit allows you to create custom question cards. When creating content, you agree that your cards must not contain:

• Hate speech, slurs, or content that promotes discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic
• Explicit sexual content or graphic descriptions
• Threats of violence or content that promotes harm to others
• Harassment, bullying, or content targeting specific individuals
• Spam, advertisements, or promotional content
• Content that promotes illegal activities
• Personal information of others (names, addresses, phone numbers, etc.)
• Content that infringes on intellectual property rights

Content Moderation

All user-created cards are subject to review. We reserve the right to remove any content that violates these guidelines at our sole discretion, without prior notice. Our moderation decisions are final.

Reporting

Users can report inappropriate cards directly within the App. We take all reports seriously and will review flagged content promptly.

Blocking Policy

Devices associated with repeated or severe violations of our content guidelines may be permanently blocked from creating or submitting content. In cases of extreme violations, devices may be blocked from using the App entirely. Blocking is applied at the device level using your anonymous device identifier.

Content Ownership

By creating custom cards in the App, you grant Firepit a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute your content within the App and related services. You retain ownership of your original content.

5. Intellectual Property

All content provided by Firepit — including but not limited to question cards, app design, graphics, logos, and text — is owned by Firepit and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

6. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App, including but not limited to:

• The App will be uninterrupted, error-free, or secure
• The results obtained from the App will be accurate or reliable
• Any defects in the App will be corrected

7. Limitation of Liability

To the fullest extent permitted by law:

• Firepit is not responsible or liable for any conversations, interactions, or outcomes that occur as a result of using the App
• We are not liable for any user-generated content created by other users
• We are not responsible for any emotional, psychological, or relational outcomes from conversations prompted by our cards
• In no event shall Firepit be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App

You acknowledge that the App provides conversation prompts only, and that you are solely responsible for how you use them and the conversations that result.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect and use anonymous data. We do not collect any personally identifiable information. Please review our Privacy Policy for full details.

9. App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

• These Terms are between you and Firepit, not Apple
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure of the App, Apple has no warranty obligation
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms

10. Termination

We reserve the right to restrict, suspend, or terminate your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms. You may stop using the App and delete it at any time.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with applicable law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
